Prepare to get a call from EPFO if you have International Worker and they don’t appear in monthly ECR filed by you.
EPFO vide Circular No. :IWU/7(68) 2014/Reconciliation of data with FRRO/15881 dated 7th March 2019 has directed their Regional Offices to ensure compliance of International Worker basis the data shared by EPFO with regional offices. Data is being collected from reliable sources, as claimed, which probably would be FRRO. EPFO further instructed regional offices to share monthly progress report
Regional Offices will pull data from data base of employer which is being maintained by them. Data pulled by them will have mismatch because
- There is no data with EPFO for IW wherein India has an SSA with the country of residence of IW and IW has submitted the COC. Based on that COC Employer is not doing compliances as IW. There is no return prescribed by EPFO wherein information about such IW is required to be submitted. All such IW will pop up as non-compliant
- Employers initially missed to find out that the employee is a IW or not. Subsequently employer went ahead and corrected the same by doing the additional contribution as IW. However PF contributions have been deposited but the status of that IW in EPFO data base is being tagged as domestic worked and not changed to IW.
Prepare yourself with all data and records since provision for IW was implemented to answer EPFO
