The operationalization of the Code on Social Security 2020 will soon be a reality. The Union Ministry of Labor and Employment (MOLE) has notified Draft Rules under The Code on Social Security 2020 vide notification number G.S.R 713 (E) dated 13th November 2020. I am attaching herewith a copy of the notification for ready reference.

The Code on Social Security 2020 consolidates the following Acts
- The Employees’ State Insurance Act, 1948 (34 of 1948),
- The Employees’ Provident Funds and Miscellaneous Provisions Act, 1952 ( 19 of 1952),
- The Employment Exchanges (Compulsory Notification of Vacancies) Act, 1959( 31 of 1959),
- The Maternity Benefit Act, 1961 (53 of 1961),
- The Payment of Gratuity Act, 1972 (39 of 1972),
- The Cine-Workers Welfare Fund Act, 1981 (33 of 1981),
- The Building and Other Construction Workers’ Welfare Cess Act, 1996(28 of 1996) and
- The Unorganised Workers’ Social Security Act, 2008(33 of 2008),
The Draft Rules, once approved and Notified as Rules, shall be so-called Code on Social Security (Central) Rules, 2020 and will supersede the following exiting Rules
- The Employees’ State Insurance (Central) Rules, 1950;
- The Tribunal (Procedure) Rules, 1997;
- The Employees’ Provident Funds Appellate Tribunal(Conditions of Service) Rules, 1997;
- The Employment Exchanges (Compulsory Notification of Vacancies) Rules, 1960;
- The Maternity Benefit (Mines and Circus) Rules, 1963;
- The Payment of Gratuity (Central) Rules, 1972;
- The Cine-Workers Welfare Fund Rules, 1984;
- The Building and Other Constructions Workers’ Welfare Cess Rules, 1998; and
- The Unorganised Workers’ Social Security Rules, 2009;

The objections and suggestions should be sent in a proforma containing column (1) specifying the name and address of the person/organization and column (2) specifying the chapter and rule or sub-rule which is proposed to be modified and column (3) specifying the revised rule or sub-rule proposed to be substituted and column (4) reasons therefor;
Objections and suggestions, received before the expiry of a period of forty-five days from the date on which the copies of the Official Gazette in which this notification is published are made available to the public; will be considered by the Central Government.
