Karnataka Maternity Benefit (Amendment) Rules, 2019

The Government of Karnataka vide notification no. LD 127 LET 2018 dated 15th July 2019 has issued The Karnataka Maternity Benefit (Amendment) Rules, 2019.

The Government of Karnataka insert new Rule 6A in Karnataka Maternity Benefit Rules, 1966 which mandates to provide crèche facility for every establishment where 50 or more employees are employed.

 

      Below are the major changes brought in by the notification:-

  1. Establishment has to provide one crèche facility for every thirty children.
  2. Crèche facility has to be provided to the children upto the age of 06 years.
  3. Crèche facility shall be provided to children for all employees (permanent, temporary, regular, daily wage & contract etc.)
  4. Crèche facility shall be located within the premises of the establishment or within five hundred (500)meters from the entrance gate of the establishment
  5. This notification also provides the standard & norms to be followed for the building and facilities of the crèche and equipment to be provided by the employer.
  6. The working hour of the crèche shall correspond to working hours of the mother or parents of the children admitted in the crèche. The crèche shall work in two or more shifts, if the women are employed in two or more shifts as per the statutory norms and spread over a period not exceeding eight hours a day.
  7.  Also maintained records for periodical health checkups and weighment of the children attending the crèche.
  8. A woman who has Government approved or recognized qualification  and training in “Early Childhood Care and Education” (ECCE) or “Teachers Course Higher” (TCH) or equivalent qualification shall work as crèche-in-charge to look after children during the absence of their mothers as teacher-cum-warden.
  9. The crèche shall also maintain such records namely (i) Every child shall be medically examined before admission to the crèche. There shall be medical check-up of the children once in 02 months and their Body-Mass index (BMI) recorded once a month.
  10. The employer also ensure that the children have access to outdoor play space which is safe, secure and well maintained ,also ensure the safety and security of the children.
